Scope of application
The following terms and conditions apply as the exclusive basis for ordering and sending goods ordered via online store on www.sponser.de at Sponser Europe GmbH. We do not recognize any conflicting or deviating terms and conditions of the purchaser, unless we have expressly agreed to their validity in writing.

Offer and Acceptance
The offers of Sponser Europe GmbH are non-binding and subject to change. They are an invitation to the purchaser to submit a binding contract offer. The acceptance of an offer takes place either by delivery of the confirmation of dispatch (e-mail) or by sending the goods. The automatically generated sales confirmation (e-mail) does not constitute an acceptance of the offer, it only informs the customer that the order has been received by us.

Cancellation policy
End users have the right to cancel this contract within fourteen days without giving any reason.

The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

To exercise your right of withdrawal, you must inform us (Sponser Europe GmbH, Heuriedweg 30, D-88131 Lindau, info@sponser.de, Tel. 08382/260 2770, Fax. 08382/260 277 99) by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. For this purpose, you may use the enclosed model withdrawal form, which is, however, not mandatory.

You can also fill out or submit the model withdrawal form or another clear declaration electronically on our website (download the model withdrawal form here as a PDF file).

To comply with the withdrawal period, it is sufficient that you send the notice of exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation
If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to Sponser Europe GmbH, Heuriedweg 30, D-88131 Lindau without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods.

You must pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary for checking the condition, quality and functioning of the goods.

Note for returns
If your return shipment falls below the free shipping limit, we reserve the right to charge the shipping costs retroactively. These will then be deducted from the order value of the return when the refund is made.

The right of withdrawal does not apply to the following contracts:
Contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

Contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.

Warranty
The warranty is governed by the statutory provisions. However, the liability of Sponser Europe GmbH for damages is excluded, as far as the damage is based on slight negligence.

Prices
The prices listed in the store are incl. legal sales tax and plus shipping costs. The prices are shown in Euro (€).

Shipping costs
a) Shipping costs for deliveries within Germany
Within Germany there are no shipping costs from an order value of 70,-- Euro. Below an order value of 70,-- Euro the standard shipping costs are 4,95 Euro. Exception: For discount-entitled dealers, as well as co-sponsoring customers, the shipping costs up to an order value of 200,-- Euro will not be paid by Sponser Europe GmbH. For cash on delivery deliveries the costs are always an additional flat rate of 7,50 Euro to the standard shipping costs.

b) other countries
If the delivery takes place outside of Germany, the whole point 6a has no validity. Instead, the following shipping costs apply unless the order can be placed directly with a country distributor (cash on delivery is not possible here):

Italy, France, Czech Republic, Poland, Belgium, Luxembourg, Netherlands and Croatia up to 100,-- Euro shipping costs of 8,95 Euro. For other European countries up to 150,-- Euro the shipping costs are 10,-- Euro.

Possible surcharges for outer districts will be communicated in advance. Delivery to other countries is only on request.

Customs duties and import tax
When importing goods into countries outside the EU, import duties may be incurred, which the customer has to bear. These vary in different customs areas. The customer is responsible for the proper payment of the necessary customs duties and fees. Import duties are not shipping costs. Sales tax is not shown for deliveries to non-EU countries. Sponser Europe GmbH basically delivers only to EU countries without exception. Orders outside the EU can be requested from Sponser Sport Food AG (Switzerland):

Terms of payment/variations
Within Germany all listed payment options are available. Outside of Germany, only the payment options credit card, PayPal and prepayment are offered.

a) Invoice
The payment method invoice is offered by us under reserve. We reserve the right to obtain (automatic) credit information in order to protect our legitimate interests (see point 14). We accept the payment by invoice in principle maximally up to an invoice amount of 200, - euro and only after all open calculations are settled by the customer.

The invoice must be paid in full (in particular without discount) within 10 days of receipt. Otherwise, the invoice recipient will automatically be in default according to § 286 para. 3 BGB (German Civil Code) even without further reminders. If you are in default with your payments, the reminder fees under point 9 shall apply.

b) Direct debit (elektr. Lastschriftverfahren ELV)
Persons residing within Germany can pay from a German account by direct debit. We will collect the invoice amount from the customer's specified account by means of SEPA-Basis-Lastschriftverfahren. When paying by direct debit, please ensure that there are sufficient funds in the account and that the account details are correct. If we incur costs due to chargebacks for which the customer is responsible or due to unjustified objections by the customer, the customer shall bear the costs incurred by us for the chargeback. The payment method direct debit is offered by us under reservation. We reserve the right to obtain credit information in order to protect our legitimate interests (see point 14). Should customers be in arrears with payments, the reminder fees under point 9 shall apply.

c) Prepayment (payment in advance)
We inform the customer in the order confirmation of our bank details for the transfer. The customer has to transfer the money to our account within 10 days after receipt of the order confirmation at the latest. Otherwise we reserve the right to cancel the order or withdraw from the contract. We will ship the goods only after the money has been credited to our account.

d) Credit card
Payments with a Visa or Master Card are accepted. Your credit card account will be charged only after the goods have been shipped.

e) PayPal
Prerequisite for this payment use is your registration with PayPal (www.paypal.de). PayPal allows the possibility to pay also with other - here not listed - payment variants.

f) Cash on delivery
For payment by cash on delivery, we charge a cash on delivery fee of 7.50 euros regardless of the order value and other possible standard shipping costs. In case of rejection of the order respectively passive default of acceptance we charge a lump sum of 19,-- Euro.

Payment due dates / reminder fees
In principle, payment is due immediately after ordering for all payment options. If payment on account is offered, the payment period is 10 days. This is a fixed date. If payment is not made by the due date, the following reminder fees will be charged:

1st reminder: € 5,--
2nd reminder: € 5,--
3rd reminder: €15,--

In the case of proven and deliberate attempts at fraud, a fee of €100,-- will be charged.

Terms of delivery
Sponser Europe has the right to make partial deliveries. The delivery at UPS can be (re)tracked by means of a code sent by e-mail.

Retention of title
The goods remain the unrestricted property of Sponser Europe GmbH until full payment has been received.

Disclaimer
We would like to explicitly point out that due to different jurisdictions and interpretations by controlling bodies in different countries, we cannot guarantee the legal conformity of our advertising texts. They are written to the best of our knowledge and belief, but the publication of formulations from the Sponser homepage or info sheets is exclusively at your own risk. Credit assessment
The customer agrees that SPONSER EUROPE GMBH may at any time grant third parties involved in the credit assessment of the customer as well as in the collection of the purchase price (in particular the credit agency CRIF AG, Zurich, or a company affiliated with it) access to his personal data originating from the business relationship, including all payment experiences from the order process. The customer is entitled to revoke his above consent in writing at any time. The data on a data subject transmitted by the customer in the context of an inquiry will be stored in the CRIF database for the operation of the credit agency and to ensure the accuracy of the data.

Privacy
Sponser Europe will of course treat your personal data responsibly and confidentially. The data necessary for order processing is processed and stored in accordance with the applicable data protection laws. If necessary for order processing, the data may be passed on to affiliated companies (Sponser Sportnahrung AG, CH) as well as third parties involved in order processing (payment service providers and acquirers). If you no longer agree to the storage of personal data or if this data has become incorrect, we will arrange for the deletion of your data on the corresponding instruction. Upon request, we will provide you with information on all data stored by us. For further questions regarding the collection, processing and use of your personal data, please contact us. Place of performance
Place of performance is D-88131 Lindau, Heuriedweg 30 at Sponser Europe GmbH. In the case of generic goods, the debtor bears the risk of performance (for example, when shipping via a parcel delivery service such as UPS). Our parcel delivery service UPC does not deliver to packing stations.

Applicable law and place of jurisdiction
The law of the Federal Republic of Germany shall apply to the exclusion of the laws on the international purchase of movable goods. The exclusive place of jurisdiction is the local court of Lindau/B, as far as this is legally possible.

Final Provisions
Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.
